User asked:
Is Daughter Liable for Father's Personal Loan after his Demise and can her salary be attached

My Father took one loan (KISAN CREDIT CARD) from one of the bank in 2012 and same has been turn NPA in MAY 2015.I got the job in the same bank as officer in September 2015.Now the bank didn't send any notice from 2015 to 2021 even after the account turn NPA. My father got brain haemorrhage in 2016 and not in a condition to remember anything after that and eventually passed away in 2019 January . Now in November 2021 my bank came to know about me that my father took the loan and started pressurize me to settle the full outstanding amount. When I told them neither me nor any of my family member know about the loan they simply started to threatened/Pressuring me to settle the amount or they will HOLD MY SLARY AND SQUARE OFF THE LOAN FROM MY SALARY as I work in that bank. So, my question is 1-Can bank have the right to hold my salary even if I didn't know about any of this loan till date. 2- Is my mother and only brother is liable to repay the loan (NO WE DIDN'T INHERITED ANY PROPERTY FROM MY FATHER) **BANK didn't send any notice from 2015 regarding the loan. The Bank is A PSU BANK **They are stating that "LAW ALLOWS THEM TO HOLD MY SALARY AND OTHER BENIFITS" Kindly Guide me as I am in a verge of a breakdown. The loan has become time barred. So it cannot be recovered. The time limit for recovery of loan is three years only from the date of signing of loan documents or from the date of last deposit of installment made in the account of your father. Or from the debt acknowledgment The Bank cannot use pressure tactics against you, this is all illegal activity on their part. Now the bank cannot file even a civil suit for recovery because 3 years time( limitation period) has passed. Now the only alternative they have is to close the account as bad debt. The bank officials are at fault for its non recovery in time for which departmental action can be taken against them by the Bank's senior authorities. You cannot be held guilty at all because you are no where involved in the loan. All the best.
